We offer a wide range of dog products, from accessories (leashes, collars, carriers) to toys, beds, bowls, and much more. All our items are carefully selected for their quality and usefulness.

Can I return a product if it doesn't suit me? What are the conditions?

Of course! If a product does not suit you, you can return it within 30 days from the date of receipt. Items must be in their original condition and unused. We will refund you in full.

General Conditions of Sale (GCS)

Scope of application

The General Terms and Conditions of Sale (hereinafter "GTC") apply to all legal transactions concluded in the online shops www.doggyland.ch (hereinafter individually referred to as "online shop").

The General Terms and Conditions also apply to all legal transactions concluded within the framework of the doggyland.ch merchant program (hereinafter referred to as the "merchant program"). In the merchant program, individually selected third-party providers (hereinafter referred to as "merchants") may offer products and services in their name and sell them directly to customers from the doggyland.ch online shops.

Doggyland.ch reserves the right to modify these Terms and Conditions at any time. The version of the Terms and Conditions in effect at the time of the order is decisive and cannot be unilaterally modified for that order. Customer conditions that contradict or deviate from these Terms and Conditions are not recognized.

The offer is valid as long as the product can be found in the online store using the search function and/or while stocks last.

Doggyland.ch reserves the right to refuse orders exceeding the usual quantities for a household.

Information

  • Product and price

Product images in advertising, brochures, online shops, etc. are for illustration purposes only and are not binding.

All sales prices published in the online shop are final prices, which include all taxes (including VAT), any advance recycling fees (ART), packaging costs, as well as delivery costs for the requested delivery period and any other taxes or fees. Doggyland.ch and the merchants reserve the right to change the prices of the products and services offered at any time. The price indicated in the online shop at the time of the order is decisive for the conclusion of the sales contract.

Customers must file a complaint regarding the import duty notice within seven (7) business days of its receipt or availability. After this period, any recourse brought by the customer against doggyland.ch for any defect in the import duty notice is excluded.

  • Availability and delivery time

Doggyland.ch places great importance on displaying the most up-to-date and accurate availability and delivery times in the online shop. However, due to production or delivery issues, delivery delays may occur at retailers. Therefore, all information regarding availability and delivery times is provided for informational purposes only and is subject to change at any time.

  • Additional services: assembly and disposal

Assembly includes delivery, unpacking and assembly of the ordered products, including the removal of packaging material.

Disposal includes the collection and environmentally friendly disposal of the items specified by the customer at the time of ordering. These must correspond as closely as possible to the type and quantity of the order. The products to be disposed of must be prepared by the customer so that they are transportable and ready for delivery on the agreed date of the order.

If the installation service cannot be carried out due to a reason given by the customer (e.g. failure to comply with the installation date, incorrect indication of dimensions, etc.), the customer is not entitled to a refund of the installation service paid.

Conclusion of the contract

The products and prices published in the online store are considered offers. However, these offers are always subject to the resolutory condition of impossibility of delivery or an incorrect price indication.

For doggyland.ch products and services, the contract is concluded with doggyland.ch as soon as the customer places their order in the online store.

For products and services offered by a merchant, the contract is concluded directly between the merchant and the customer when the order is placed in the online shop. Doggyland.ch only acts as a mediator. In this case, Doggyland.ch only acts as an intermediary and service provider for the merchant, but does not itself become a contracting party. Customers must pay in Swiss francs.

When purchasing, customers can see in the online shop as well as on the invoice who the supplier/contracting party is (i.e. doggyland.ch or a merchant).

In the case of an online order, receipt of the order is confirmed to the customer by means of an automatically generated order confirmation by email. Receipt of the automatically generated order confirmation does not contain confirmation that the product can actually be delivered. It only informs the customer that the online shop has received their order and that the contract has therefore been concluded with Doggyland, provided that the order can be delivered and the price indicated is correct.

When the order is acknowledged, a provisional delivery date is indicated to the customer. In the case of home delivery, a delivery date is agreed upon with the customer.

In the event of a delivery delay by doggyland.ch, the customer is entitled (except for special orders) to withdraw from the contract from the 90th calendar day following the initially announced delivery time. In this case, doggyland.ch will reimburse the customer for any amounts already paid. There is no possibility of claiming against doggyland.ch.

Delivery

For products and services from doggyland.ch, all delivery options in the online shop under "Delivery" are available to customers.

Products and services that customers purchase from a merchant can only be sent to them.

The delivery address must be in Europe and easily accessible by truck.

If the customer chooses the "delivery to the place of use" option, it is their responsibility to ensure that access to the place of use is possible and guaranteed. The customer must check whether the product fits through the access points (e.g. stairs, doors, etc.). If the product cannot be transported to the place of use, the customer will bear any additional costs.

If it does not receive the ordered products on the agreed or indicated delivery date, Doggyland or the trader may terminate the contract (cancellation) and charge the customer for the delivery costs incurred and any loss in value.

Duty of customer control

It is also the customer's responsibility to check the delivered products immediately after receipt for their accuracy, completeness and functionality.

If delivery was made by a transport company, any damage to the delivery must be specified on the delivery note.

Any errors or damages must be reported to doggyland.ch immediately upon discovery or at the latest within 5 calendar days of receipt of the products. Customers are aware that such damages must be reported via their personal customer account in the online shop under "Returns, Repairs, and Support." Customers are not permitted to use a damaged product. They must keep it in its original packaging and follow the return process instructions under "Returns, Repairs, and Support" in their customer account.

Guarantee

  • General provisions

Doggyland guarantees the absence of defects and proper functioning of the ordered product for 2 years after delivery. The warranty period continues to run even if a warranty service has been provided. Doggyland.ch can provide the warranty service alternatively by

  1. partial or total replacement with a used product of the same value (in the event of replacement during the 1st year of warranty, the initial warranty period continues to run, in the event of replacement during the 2nd year of warranty, the warranty period is one year from the date of replacement);
  2. a replacement with a new product by Doggyland (new warranty period of 2 years from the date of replacement);
  3. a credit at the current price (maximum the sale price at the time of the order); or
  4. a discount.

 Wear parts, particularly batteries, power cords, light bulbs, and software problems are excluded from the doggyland.ch warranty. For all other matters, the liability exclusions set out in Section 8 apply.

To the extent that the manufacturer's warranty exceeds the doggyland.ch warranty, doggyland.ch also grants the latter to the customer.

If a data carrier or product containing data storage is handed over to doggyland.ch, complete data loss must be expected in all cases. Customers are responsible for the proper backup and protection of their data. Doggyland.ch assumes no liability for any data loss.

All other provisions and in particular statutory warranty provisions are excluded.

Liability and exclusion of liability

  • Responsibility

Liability is subject to the provisions defined by law. However, doggyland.ch shall never be liable for (i) slight negligence, (ii) direct, indirect, and consequential damages, loss of profit, (iii) lost savings, as well as (iv) damages resulting from late delivery, and (v) any actions or omissions of auxiliaries of doggyland.ch or a merchant, whether within the framework of a contract or outside of any contract.

Furthermore, doggyland.ch disclaims all liability for the following reasons:

  1. improper, contractually unlawful or unlawful storage, positioning or use of the product;
  2. use of incompatible accessories or spare parts (e.g. power supply);
  3. lack of maintenance and/or improper modification or repair of the product by the customer or a third party;
  4. in the event of force majeure, in particular damage caused by the elements, humidity, falls, blows, etc., which cannot be attributed to doggyland.ch and the authorities.
  • Limitations of liability

Doggyland.ch disclaims any liability for any loss or damage of any kind – whether direct, indirect, or consequential – resulting from the use of or access to Doggyland websites or links to third-party websites. Doggyland.ch does not guarantee the trouble-free operation of all parts of its website. Furthermore, doggyland.ch disclaims any liability for the manipulation of an Internet user's computer system by unauthorized third parties.

Payment

  • Payment methods

Doggyland.ch sends payment requests for products and services purchased from the doggyland.ch online stores directly to customers. Upon conclusion of the contract, the merchant assigns the entire claim arising from the purchase contract between the merchant and the customer to doggyland.ch (assignment). Customers acknowledge this assignment and are required to make all payments exclusively to doggyland.ch.

Customers can use the payment methods offered in the online store under “Payment Methods”.

The current fees are indicated in the “Payment Methods” section and are detailed in the order process.

In case of payment by credit card or other instant payment methods, the debit takes place at the time of the order.

In the case of advance payment, delivery will only take place after receipt of payment. Products in stock at the doggyland.ch central warehouse are reserved until the expiry of the payment period, which is at least 11 calendar days. This also applies to products that are initially ordered externally but are processed and shipped from our warehouse. Products that are to be delivered first by an external distributor will only be ordered once payment has been made.

  • Retention of title

Ordered products remain the property of doggyland.ch until full payment has been received. Doggyland.ch is entitled to make a corresponding entry in the retention of title register. Prior to the transfer of ownership, no pledge, assignment as security, transformation, or modification is permitted without the express consent of Doggyland.ch.

Modification or cancellation of the order

Orders require the customer to receive the products and services. Doggyland.ch may, at its sole discretion, accept subsequent changes or cancellations of orders and charge compensation of 20% of the amount of the canceled order, but at least CHF 60.–, as well as any loss in value (since the order) of the canceled products.

If a (partial) delivery impossibility (resolutory condition) occurs after the order has been placed or the contract has been concluded, the customer will be informed immediately by email. If the order has already been paid, the amount will be refunded. Any further rights related to a delay or impossibility of delivery are excluded.

Return of goods delivered without defects

Under the return conditions listed, doggyland.ch grants the right to return ordered products. The options for returning a product and the return period are listed on the relevant product page under the "Returns and Warranty" section.

Customers must register the return of products themselves in their customer account under "Returns, Repairs and Support" on www.doggyland.ch, and return the goods to the address provided. Products must be sent with all accessories in the original packaging and properly packaged. Damaged products will not be accepted and will be invoiced to the customer in full.

If a data carrier or product containing data storage is handed over to doggyland.ch, a complete loss of data must be expected in all cases. Customers are responsible for the proper backup and protection of their data. doggyland.ch accepts no liability for any data loss.

If customers exercise their right of return in accordance with the above-mentioned return conditions, doggyland.ch will refund the full purchase price, excluding any minimum quantity surcharge that may have been paid.

In the event of a return of products that have been subject to import customs clearance on behalf of the customer, the customer authorizes and mandates doggyland.ch to declare the export of the returned products to customs and to request a refund of Swiss import duties and taxes on behalf of the customer. If the customer has not been able to deduct the import tax or has only partially been able to deduct it as input tax and if the other conditions for the refund of the import tax due to the re-export of the ordered products are met, doggyland.ch will then refund the import taxes paid in advance by the customer after receipt of the corresponding amount from the Federal Customs Administration. For companies registered in the Swiss or Liechtenstein VAT register, proof of the non-deductibility of the import tax must be provided by a corresponding certificate from the Federal Tax Administration.

In this context, the customer guarantees doggyland.ch that the details and list of returned products are complete and accurate according to the return slip generated by the customer during the return process, and that the return actually contains the products designated on the return slip. The customer fully indemnifies doggyland.ch against any claims from third parties in connection with an incomplete or incorrect customs declaration submitted by the customer. Doggyland.ch reserves the right to verify the data provided by the customer as part of random checks.

Out-of-warranty repair

The cost of out-of-warranty repairs is the customer's responsibility. Doggyland.ch reserves the right to charge customers for the costs incurred by inspecting and returning products with hidden defects or damage not covered by the manufacturer's warranty.

Other provisions

  • Unidentifiable returns

Returns for which we have no sender information and which therefore cannot be returned (due to missing data) are kept for six months by doggyland.ch before being deleted.

  • Merchandise repaired under warranty not sought or cannot be returned

If goods that have been repaired under warranty are not collected by the customer from one of our branches within six months of the collection invitation being sent or cannot be returned to the customer, Doggyland is entitled to dispose of the goods, including disposal.

  • Data protection

The data protection declaration applies to the processing of personal data by doggyland.ch.

  • Partial nullity

If certain provisions of these General Terms and Conditions should prove to be null or void, the validity of the other provisions of the contract shall not be modified in any way.

  • Jurisdiction and applicable law

All legal relationships between doggyland.ch and customers are subject to substantive Swiss law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Only the following jurisdictions apply:

For all disputes arising from sales contracts with doggyland.ch as the contracting party, and legal actions brought by consumers, the place of jurisdiction is Geneva.

For all disputes arising from sales contracts with a merchant as the contracting party, the place of jurisdiction is the merchant's registered office.

For all disputes arising from sales contracts with a merchant as the contracting party, the place of jurisdiction is the merchant's registered office.

Any reproduction, distribution, or other use is prohibited and is only permitted with the express written consent of doggyland.ch. In the event of non-compliance with this directive, doggyland.ch reserves the right to initiate legal proceedings.
